Can You Buy Edibles Online Legally?

Yes, but it depends on the type of edibles. Dispensary edibles (marijuana products) can only be bought online through a state-licensed dispensary for in-store pickup or in-state delivery from a licensed courier. Hemp-derived edibles can be shipped nationwide, provided they contain 0.3% or less Delta-9 THC (dry weight), and the state hasn’t banned them.

Dispensary Edibles vs. Hemp-Derived Edibles

Whether you can buy edibles online legally comes down to the type.

  • Dispensary edibles are made from marijuana and typically contain higher levels of Delta-9 THC (THC-D9). They’re regulated under state cannabis programs and can only be bought and sold through licensed dispensaries in states where recreational cannabis is legal.
  • Hemp-derived edibles come from hemp plants with 0.3% or less THC-D9 by dry weight. Under the 2018 Farm Bill, these are federally legal and can be shipped nationwide via USPS, though state laws vary. They often feature blends like CBD, CBG, CBN, CBDA, and THCA.

 

Buying Dispensary Edibles Online

If you’re 21 or older and live in one of the following 23 states, you can place orders online from a licensed dispensary for pickup or in-state delivery (if offered):

  • Missouri
  • Arizona
  • Vermont
  • Illinois
  • New Mexico
  • Colorado
  • Connecticut
  • Oregon
  • Michigan
  • Rhode Island
  • New York
  • Massachusetts
  • Delaware
  • California
  • Ohio
  • Nevada
  • Minnesota
  • Alaska
  • Maryland
  • Maine
  • Washington
  • New Jersey
  • Montana

 

Soon, Virginia and Hawaii will be added to this list. They’ve both legalized the possession of marijuana but have not launched retail sales.  It’s also important to know that such products cannot be mailed across state lines. This remains a federal crime under 21 U.S.C. § 841, regardless of whether both states have legalized cannabis.

 

Buying Hemp-Derived Edibles Online

Hemp-derived edibles can ship to most US states through USPS, but rules do vary. For example, Idaho and Kansas have banned them entirely. Other states, like Alaska, Arkansas, Ohio, Tennessee, South Dakota, and Wyoming, have also restricted certain cannabinoids like THCA and Delta-8.

 

The Process of Ordering Edibles Online

For dispensary edibles, you’ll need to be in a state where marijuana is legal. You can then browse a licensed shop, place an order for gummies, chocolates, or drinks online, and collect it from the store or get it through licensed in-state delivery.  With hemp-derived edibles, on the other hand, ordering online feels like regular shopping, just with an age check. You choose your products, confirm your age at checkout, pay by card, and wait for delivery.

Both require you to have a valid government-issued ID that verifies you’re 21 or older. This either needs to be shown in-store or online through the vendor’s online age verification process.
